Terms of Use

This is a convenience translation. In the event of any discrepancy, the German version shall prevail.

1. Acceptance of Terms of Use

1.1. By downloading, installing, or using myvyo (a service of POLLION GmbH), you agree to these Terms of Use.

1.2. If you do not agree with these terms, you may not use myvyo.

1.3. These Terms of Use supplement our General Terms and Conditions (GTC), Privacy Policy, and our Cancellation Policy.

2. Intended Use

2.1. myvyo is a health and wellbeing app that reads your health data from Apple Health or Google Health Connect, analyses it, and provides you with personalised insights and recommendations.

  Important notice: myvyo is not a medical device and does not provide medical advice, diagnosis, or treatment. AI-generated insights are intended solely for informational and motivational purposes. For health-related questions, always consult a qualified healthcare professional.

✓ You may:

Personal tracking: Track and analyse your own health data,
Use AI insights: Use the AI-generated recommendations as suggestions and motivation,
Data export: Export your personal data in JSON format,
Provide feedback: Submit improvement suggestions and bug reports.

✗ You may NOT:

Medical substitute: Use the app as a substitute for professional medical advice,
Account sharing: Share your access with other people or allow third-party use,
Reverse engineering: Decompile, disassemble, or reverse-engineer the software,
Automation: Use automated tools, bots, or scrapers for mass queries of AI insights,
Competing products: Use AI insights or app content to create competing products,
Manipulation: Manipulate health data to provoke erroneous AI analyses,
Misuse: Use the app for illegal purposes or to the detriment of third parties,
Security circumvention: Circumvent or attempt to circumvent access controls, rate limits, or security measures.

3. Health Data and Permissions

3.1. myvyo requires your explicit permission to read health data from Apple Health or Google Health Connect.

3.2. You can revoke these permissions at any time in your device’s system settings.

3.3. Without access to health data, the app can only be used to a limited extent (manual mood/energy entry).

3.4. The Cloud AI feature requires an additional, separate consent within the app.

4. User Responsibilities

4.1. You are responsible for the accuracy of data you manually enter (mood, energy, notes).

4.2. You must not use the app for any unlawful purpose.

4.3. You are responsible for the security of your device and for protection against unauthorised access.

5. Intellectual Property and Copyright

5.1. Property rights: All content in myvyo (AI insights, graphics, software, texts, logos, design) is protected by copyright and is the property of POLLION GmbH or its licensors.

5.2. Licence grant: By using the app, you receive a simple, non-exclusive, non-transferable right to use it for personal purposes (see § 7 GTC).

5.3. Your data: All health and wellbeing data entered by you and stored on your device belongs to you. You can export or delete it at any time.

6. AI-Generated Content

6.1. The AI-generated insights and recommendations are created based on your anonymised health data.

6.2. AI insights may be inaccurate, incomplete, or incorrect. They do not constitute medical, psychological, or any other professional advice.

6.3. We make no guarantees regarding the accuracy, completeness, or timeliness of AI-generated content.

6.4. Decisions you make based on AI insights are your own responsibility.

7. Suspension for Misuse

7.1. We reserve the right to restrict or suspend access to the app in the event of violations of these Terms of Use.

7.2. Grounds for suspension:

Violation of the Terms of Use or GTC,
Illegal activities,
Misuse of AI services (automated mass queries, etc.),
Circumvention of security measures.

7.3. In the event of suspension, there is no entitlement to a refund of already paid amounts unless the suspension was made in error.

8. Changes to myvyo

8.1. We reserve the right to change, expand, or restrict myvyo at any time.

8.2. Feature updates: New features may be added at any time (e.g. new health metrics, improved AI models, additional languages).

8.3. Feature discontinuation: We may discontinue features if they are no longer economically or technically viable. We will inform you of such changes in good time.

8.4. Changes to the scope of features do not entitle you to cancellation with a refund claim unless the feature set is significantly reduced.

9. External Links and Third-Party Services

9.1. myvyo may contain links to external websites (e.g. to Apple Health, to Mistral AI’s privacy policy).

9.2. We have no influence on the content of external websites and accept no liability for their content.

9.3. The use of external services is at your own risk and is subject to the respective terms of use of the third-party providers.

10. Changes to the Terms of Use

10.1. We reserve the right to amend these Terms of Use with effect for the future.

10.2. You will be informed of changes at least 4 weeks in advance by email or in-app notification.

10.3. If you do not object to the changes within 4 weeks, the changes are deemed accepted.

10.4. In the event of an objection, you may terminate your subscription extraordinarily at the time the changes take effect.

11.1. We welcome your feedback and suggestions for improvement!

11.3. By submitting feedback, you grant us the right to use and implement your suggestions without compensation.

13. Applicable Law, Jurisdiction, and Severability Clause

13.1. These Terms of Use are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the user has their habitual residence remain unaffected.

13.2. Where the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Berlin, Germany.

13.3. Severability clause: Should individual provisions of these Terms of Use be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.
