Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date of the conclusion of the contract (date of purchase confirmation in the app store).

by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

To comply with the withdrawal deadline, it is sufficient for you to send the communication regarding the exercise of your right of withdrawal before the expiry of the withdrawal period.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract.

For such reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case shall you be charged any fees for this reimbursement.

Note regarding App Store purchases: Since payment processing is handled by the Apple App Store or Google Play Store, refunds are typically processed directly by Apple or Google. Please use the respective support channels for refunds:

Premature Expiry of the Right of Withdrawal

⚠️ Important: Waiver of the right of withdrawal upon immediate provision of services

The right of withdrawal expires prematurely for a contract for the provision of services if the entrepreneur has fully performed the service and has only begun to perform the service after the consumer has given express consent and has at the same time confirmed their knowledge that they will lose their right of withdrawal upon complete performance of the contract by the entrepreneur.

What does this mean for myvyo subscriptions?

Since myvyo is a digital service that grants you immediate access to premium features upon conclusion of the subscription, the following applies:

Immediate access: After successful payment, you immediately receive access to the premium features (Cloud AI insights, pattern analysis, trend reports, etc.).
Your express consent: By purchasing the subscription in the app store and subsequently using the premium features, you consent to the immediate provision of services.
Loss of the right of withdrawal: Upon full provision of access (immediately after payment), your right of withdrawal expires pursuant to § 356(5) BGB (German Civil Code).

Summary: If you immediately access the premium content after concluding your subscription, you lose your 14-day right of withdrawal. This occurs with your consent during the purchase process in the app store.

Exceptions and Special Cases

1. Technical Problems

If you were unable to access the premium features due to technical problems, your right of withdrawal remains in force. Please report technical problems immediately to: info@myvyo.ai

2. Free Trial Period

If a free trial period is offered, the withdrawal period does not begin until the first paid billing period. You can cancel the subscription at any time during the trial period at no cost.

3. Refund via the App Store

Regardless of your statutory right of withdrawal, you can submit refund requests for in-app purchases directly to Apple or Google. The refund policies of the app stores may be more generous than the statutory right of withdrawal.

Monthly subscriptions:
